TERMS & CONDITIONS OF THE ONLINE STORE HOZZESTORE.EU
§1. DEFINITIONS
Online Store – the online store available at https://hozzestore.eu operated by the Seller.
Regulations – these Terms and Conditions of the Online Store, referred to in Article 8 of the Polish Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2019, item 123, 730).
Seller – HOZZE Spółka z ograniczoną odpowiedzialnością (limited liability company) with its registered office at ul. Kwiatowa 1, 63-322 Gołuchów, Poland, entered in the National Court Register under number KRS 0000945373, NIP (Tax ID): 6080120501, REGON: 520955096, email: hello@hozzestore.eu.
Buyer – a Consumer using the services provided electronically by the Seller within the Online Store or concluding a Sales Agreement with the Seller.
Consumer – a natural person concluding a Sales Agreement with the Seller or using the Store’s services not directly related to their business or professional activity.
Registration Form – the form enabling the creation of an Account in the Store.
Account – the Buyer’s individual profile in the Online Store.
Order Form – the form used to place an Order.
Order – the Buyer’s declaration of intent constituting an offer to conclude a Sales Agreement.
Sales Agreement – a sales agreement concluded between the Seller and the Buyer through the Online Store.
Cart – a tool enabling the Buyer to collect selected Products before purchase.
Product – a movable item being the subject of the Sales Agreement.
Proof of Purchase – a receipt or a VAT invoice.
Newsletter – a service consisting of sending commercial information electronically after the Buyer’s consent.
Privacy Policy – a document defining the rules for the processing of personal data.
Civil Code – the Polish Civil Code Act of 23 April 1964 (Journal of Laws of 2019, item 1145, 1495).
§2. GENERAL PROVISIONS
These Terms & Conditions define the rules for concluding and performing Sales Agreements and for providing electronic services by the Seller.
Services provided electronically include:
a) concluding Sales Agreements,
b) creating and maintaining an Account,
c) receiving the Newsletter.
Any announcements, advertisements, and information about Products constitute an invitation to conclude a contract within the meaning of Article 71 of the Polish Civil Code.
The Store conducts sales from the territory of Poland.
4a. Sales are carried out exclusively to customers residing within the European Union.
4b. All prices presented in the Store are in euros (EUR).
4c. Agreements are concluded in Polish or English. In case of discrepancies, the Polish version prevails, subject to the mandatory provisions of the Consumer’s country of residence.
All Products are original, brand new, and free from defects.
The Seller exercises the utmost diligence in fulfilling orders.
The Store may organize promotions in accordance with §12 of these Terms & Conditions.
The provisions of these Terms & Conditions do not exclude the Consumer’s rights arising from applicable law.
To use the Store, an Internet-enabled device and a web browser are required.
The Buyer bears the cost of returning goods in the event of withdrawal from the contract, including shipping costs, regardless of the country from which the return is made.
§3. USING THE STORE
The Buyer is obliged to use the Store in accordance with the law and good manners.
The Buyer must provide truthful data when using the Store.
It is forbidden to provide third-party data without their consent.
§4. ACCOUNT CREATION
Creating an Account requires filling out the Registration Form and confirming the registration via an activation link sent by email.
The Account is created for an indefinite period and may be deleted at any time upon request sent to hello@hozzestore.eu.
§5. PLACING AND PROCESSING ORDERS
Orders may be placed 24 hours a day, 7 days a week via the Store.
A Sales Agreement is concluded upon the Buyer’s receipt of an order confirmation from the Seller.
The Seller processes orders immediately after receiving payment confirmation, but no later than within 7 business days.
§6. PAYMENTS
All prices in the Store are given in euros (EUR) and include VAT.
The Buyer is informed of the total price, including delivery costs, before placing the Order.
A Proof of Purchase is attached to each order.
Available payment methods: Apple Pay, Google Pay, Visa, Mastercard, PayPal, iDEAL, Bancontact.
The Buyer selects the payment method when placing the Order.
If payment is not received within 7 days, the Seller may cancel the order.
Until full payment of the sale price and delivery costs, the goods remain the property of the Seller.
§7. DELIVERY
Delivery is carried out by DPD courier service.
The estimated delivery time is 3–7 business days from the date of dispatch.
The delivery cost is automatically calculated when placing the Order.
Delivery is free for orders of at least 100 euros.
The Buyer is obliged to collect the shipment.
The Seller recommends checking the package in the presence of the courier.
§8. COMPLAINTS
The Seller is liable to the Consumer for the non-conformity of goods with the contract in accordance with the EU Consumer Rights Directive.
If a defect is found, the Buyer should inform the Seller.
The complaint should include: the Buyer’s name, contact details, order number, description of the defect, date of discovery, and the requested action.
Complaints can be submitted to:

A receipt is not required for the complaint – another proof of purchase is sufficient.
The Seller will process the complaint within 14 days of receipt. Lack of response within this period means the complaint is accepted.
§9. RIGHT OF WITHDRAWAL
The Consumer has the right to withdraw from a distance contract within 14 days from receiving the Product, without giving any reason.
The withdrawal statement should be sent by email to hello@hozzestore.eu or by post to the Seller’s address.
The Product must be returned within 14 days of submitting the withdrawal statement.
The Buyer bears the direct cost of returning the Product, including transport costs, regardless of the country from which the return is made.
The Seller refunds the payment within 14 days of receiving the returned Product or proof of dispatch.
Refunds are made using the same payment method used for the purchase.
The Store does not accept cash-on-delivery parcels.
For returns from countries other than Poland, the Product should be sent to:
HOZZE Sp. z o.o., ul. Kwiatowa 1, 63-322 Gołuchów, Poland.
§10. PERSONAL DATA PROTECTION
The Seller is the Administrator of personal data.
Data is processed in accordance with the GDPR and the Privacy Policy available on the Store’s website.
The Buyer may withdraw consent to receive the Newsletter at any time.
Persons under 16 years of age may subscribe to the Newsletter only with the consent of their guardian.
§11. FINAL PROVISIONS
The Seller may introduce temporary technical breaks in the operation of the Store.
The Seller reserves the right to amend these Terms & Conditions with 7 days’ notice.
Any disputes may be resolved amicably or through the ODR platform: https://ec.europa.eu/consumers/odr.
In matters not regulated herein, Polish law shall apply.
For Consumers residing in EU countries, the mandatory provisions of their country of residence shall also apply.
§12. PROMOTIONS AND DISCOUNTS
The Store may organize promotional campaigns offering percentage or fixed-amount discounts.
The Store does not use crossed-out prices or display information about “previous prices.”
